1. Presentation and Scope of Application

These Terms govern all sales made by METROPOLE PRODUCTS S.L. through www.metropole.es and authorized marketplaces in Spain, Portugal, France and Italy. By placing an order, the Customer accepts these Terms.

2. Products

Product descriptions, dimensions and specifications are provided for information purposes. Minor variations in colour, finish or appearance shall not constitute a defect. Products are offered subject to availability.

3. Orders

Orders become binding once payment has been accepted. METROPOLE reserves the right to refuse or cancel orders in cases of pricing errors, suspected fraud, payment issues or product unavailability.

4. Prices

All prices are shown in Euros (€) and include applicable VAT. Shipping costs are displayed separately where applicable.

5. Payment

Orders are processed only after receipt of full payment.

6. Delivery

Delivery is available within Spain, Portugal, France and Italy. Delivery is made to street level (curbside delivery). Customers are responsible for ensuring access to the installation location. Failed deliveries due to customer absence, incorrect addresses or refusal of delivery may result in additional transport, storage or redelivery charges.

6.1 Receipt and Inspection of Products

The Customer must inspect Products immediately upon delivery. If any visible damage, shortage or discrepancy is identified, the Customer must note it on the carrier's delivery receipt and retain photographic evidence.

If the Customer observes visible damage including scratches, cracks, chips, dents, impact marks or any sign of transport damage, the Customer should refuse the shipment and clearly state the reason on the delivery receipt.

The Customer must notify METROPOLE within 48 hours at contact@metropole-banos.eu and provide photographs.

Failure to report visible transport damage within 48 hours may affect METROPOLE's ability to pursue a claim with the carrier.

Where a transport claim is accepted, METROPOLE may repair, replace or refund the affected Product.

7. Right of Withdrawal

Consumers have a 14-day withdrawal right from delivery. Returned products must be unused, complete and in original packaging. Return transport costs are borne by the Customer. Custom-made or personalized products are excluded where permitted by law.

8. Customer Account

Customers are responsible for maintaining the confidentiality of their account credentials.

9. Customer Responsibilities

Customers must provide accurate information and ensure products are suitable for the intended installation environment.

10. Privacy and Data Protection

METROPOLE processes personal data in accordance with GDPR and applicable Spanish data protection legislation. Data is used for order processing, delivery, customer service, legal compliance and fraud prevention.

11. Applicable Law and Dispute Resolution

These Terms are governed by Spanish law. Nothing in these Terms affects mandatory consumer rights applicable in the Customer's country of residence within the European Union. The parties shall attempt to resolve disputes amicably before legal proceedings.
